Two 737 MAX crashes killed 346 people. Five years after the aircraft returned to service, a door plug blew out of a nearly new MAX 9 and exposed another chain of production and oversight failures. Boeing has since changed leaders, slowed factories and promised a safety reset. Yet federal oversight remains unusually intense. This report traces the deeper history: the McDonnell Douglas merger, financial and production pressures, MCAS, delegated certification, the crashes, criminal proceedings, Alaska Airlines Flight 1282, whistleblower warnings, supplier problems and the question Boeing still has to answer — has the system changed, or only the response to each crisis?
A company that once defined engineering trust
For much of the twentieth century, Boeing was not merely an aircraft manufacturer. It was an engineering institution. The company built bombers, commercial jets, spacecraft and some of the most recognizable aircraft in aviation history. The 707 helped establish the jet age. The 747 changed long-distance travel. Boeing's reputation rested on a simple proposition: engineering excellence was the product.
That reputation is what makes the modern crisis so consequential. Boeing still builds aircraft that carry millions of passengers safely, and no responsible analysis can reduce a century-old company or tens of thousands of employees to a single narrative of failure. But official investigations have documented serious failures in design, certification, manufacturing, quality control, communication and oversight across multiple episodes.
The central question is therefore institutional. How did a company with extraordinary technical capability reach a point where two new 737 MAX aircraft crashed within five months, killing 346 people, and then, after years of promised reform, a door plug on another nearly new MAX aircraft separated in flight because four bolts that should have secured it were missing?
The merger that became a symbol
The 1997 merger between Boeing and McDonnell Douglas has become a recurring starting point in explanations of Boeing's cultural transformation. McDonnell Douglas brought major defense operations and experienced executives; Boeing brought enormous commercial-aircraft strength. The combined company was supposed to create an aerospace champion.
Critics inside and outside Boeing later argued that the merger also accelerated a shift from an engineering-centered culture toward one more focused on financial performance, shareholder returns, cost control and program schedules. Former Boeing executives and engineers have described a growing distance between senior leadership and the factories where aircraft were designed and built.
It would be too simplistic to claim that the merger caused the MAX crashes two decades later. Corporate disasters rarely have a single origin. Boeing continued to produce successful aircraft after 1997, and many decisions relevant to the MAX occurred years later under different leaders. But the merger matters because it sits at the beginning of a documented debate about what Boeing valued, how decisions were made and whether engineering authority retained sufficient weight when it conflicted with cost and schedule.
The headquarters moved away from the airplanes
In 2001 Boeing moved its corporate headquarters from Seattle to Chicago. The physical relocation became another symbol of the widening separation between top management and the commercial-aircraft engineering base in the Pacific Northwest.
Distance alone does not create unsafe airplanes. Global industrial companies routinely manage operations across continents. Yet Boeing's move reinforced a governance model in which senior corporate leadership was less embedded in the daily engineering and production environment.
The deeper issue was not geography but information flow. In safety-critical manufacturing, executives need systems that allow bad news to travel upward without being softened by schedule pressure, organizational hierarchy or fear of retaliation. Engineers and mechanics need authority to stop work when requirements are not met. Regulators need accurate information about design assumptions and production deviations. The later MAX investigations would repeatedly return to those themes.
Airbus forced a strategic decision
By the early 2010s Boeing faced intense competition from Airbus. Airbus launched the A320neo, offering airlines greater fuel efficiency while preserving substantial commonality with existing A320 fleets. American Airlines, historically a major Boeing customer, was considering a large Airbus order.
Boeing had a strategic choice: develop an all-new narrow-body aircraft or update the existing 737 again. An all-new airplane would require more time and enormous investment. Updating the 737 offered speed, lower development cost and an important commercial advantage: airlines could transition pilots with less training.
Boeing chose what became the 737 MAX. That decision was commercially understandable. The 737 had been extraordinarily successful for decades. But preserving commonality with previous generations imposed design constraints. The MAX's larger, more efficient engines had to be integrated into an airframe whose basic architecture dated to the 1960s. The way those engines were positioned changed handling characteristics in certain conditions. A software system called the Maneuvering Characteristics Augmentation System, or MCAS, became part of Boeing's solution.
MCAS: a small system with enormous consequences
MCAS was designed to command nose-down stabilizer movement under specified high-angle-of-attack conditions. Its purpose was to help the MAX handle in a manner consistent with certification requirements and expected pilot feel. The system became one of the most consequential pieces of software in modern aviation because of how it was designed, documented and certified.
In the configuration involved in the crashes, MCAS could activate based on input from a single angle-of-attack sensor. If that sensor supplied erroneous data, the system could command nose-down trim even though the aircraft was not actually approaching the condition MCAS was intended to address. It could also activate repeatedly after pilots countered it.
Pilots were not initially given a full explanation of MCAS in standard flight manuals and training. Boeing had emphasized that the MAX would not require expensive simulator training for pilots already qualified on earlier 737 models. The issue was not simply that software existed. Modern aircraft depend on software. The critical questions were the assumptions surrounding the system: sensor redundancy, pilot recognition, reaction time, documentation, certification and whether commercial objectives influenced how the system was presented.
Lion Air Flight 610
On October 29, 2018, Lion Air Flight 610 departed Jakarta in a Boeing 737 MAX 8. Shortly after takeoff, the aircraft experienced erroneous angle-of-attack information and repeated nose-down trim commands. The pilots struggled to control the aircraft. It crashed into the Java Sea. All 189 people aboard were killed.
Indonesia's final investigation identified a chain of contributing factors involving aircraft design, certification assumptions, maintenance, sensor calibration, flight-crew response and organizational issues. The disaster was not attributable to a single person or single technical defect.
The crash should have been a decisive warning. Boeing and regulators now knew that erroneous angle-of-attack data could trigger MCAS and create a rapidly escalating cockpit emergency. The MAX remained in service.
Ethiopian Airlines Flight 302
On March 10, 2019, Ethiopian Airlines Flight 302 departed Addis Ababa for Nairobi. It was another 737 MAX 8. Soon after takeoff, erroneous sensor information again triggered MCAS-related nose-down stabilizer movement. The crew fought to control the aircraft. Six minutes after departure it crashed near Bishoftu. All 157 people aboard were killed. The similarities with Lion Air were impossible to ignore. Countries around the world began grounding the MAX. The United States initially did not. On March 13, after additional evidence and international pressure, the FAA grounded the aircraft.
Together, Lion Air 610 and Ethiopian 302 killed 346 people. Those deaths are the moral center of the Boeing MAX story. Discussions of market share, certification, software, governance and corporate culture can become abstract. The consequences were not abstract. Families in dozens of countries lost parents, children, spouses, colleagues and friends.
Congress investigated not one error but a system
The U.S. House Committee on Transportation and Infrastructure conducted an extensive investigation into the design, development and certification of the MAX. Its final report described a combination of technical design flaws, management failures and regulatory weaknesses. The committee identified production pressures, faulty assumptions about pilot response, concealment or incomplete communication of important information and problems with the FAA's delegated certification process.
The report did not present the crashes as the product of one rogue engineer. That point is fundamental. Safety-critical failures become institutional when incentives, information systems and oversight mechanisms allow multiple defenses to fail at the same time.
Boeing disputed or contextualized aspects of criticism over the years and undertook major changes to the MAX before its return to service. But the congressional investigation established a public documentary record that made it impossible to treat the two crashes merely as isolated pilot-error events.
Delegated certification: when the regulator relies on the manufacturer
The FAA does not personally perform every technical certification task on every aircraft. Under the Organization Designation Authorization system, qualified employees of manufacturers can perform certain certification functions on behalf of the agency.
Delegation is not inherently improper. Modern aircraft are extraordinarily complex, and regulators need access to specialized technical expertise. Similar concepts exist in other safety-critical industries.
The danger appears when delegated representatives face conflicting organizational pressure, when regulators lack enough independent expertise or staffing to challenge assumptions, or when important changes are not elevated for deeper review.
The MAX investigations raised exactly those concerns. Congress found that the FAA had delegated significant portions of certification to Boeing and that the agency did not have complete awareness of important aspects of MCAS as the system evolved.
The lesson was not that manufacturers should never participate in certification. It was that delegation requires a regulator capable of saying no.
The business case for avoiding simulator training
Pilot training became one of the most controversial commercial dimensions of the MAX program. Airlines care enormously about training costs. If a new aircraft requires extensive simulator training, carriers must pay for simulators, instructors, pilot time and scheduling disruption. A new model that can be introduced with minimal differences training is therefore more attractive.
Boeing marketed the MAX partly around fleet commonality with earlier 737s. Internal communications later released during investigations showed intense attention to avoiding simulator requirements.
Commercial considerations do not automatically make a safety decision improper. Aircraft programs must meet customer requirements and control cost. The question is whether the desire to preserve commonality influenced design, documentation or training decisions beyond what safety should have allowed. After the crashes, regulators required additional training, including simulator training in many jurisdictions, as part of the MAX's return to service.
The MAX returned, but Boeing's institutional test had only begun
The FAA lifted the U.S. grounding in November 2020 after extensive design changes, testing and review. MCAS was modified, including changes to sensor logic and activation behavior. Training and documentation were revised. The return to service was not a declaration that Boeing's broader organizational problems had disappeared. It meant regulators had determined that the aircraft could operate safely with required changes.
Boeing then faced a different task: demonstrate that the organization that designed and built airplanes had learned from the crisis. That task proved harder.
The 2021 criminal case
In January 2021 the U.S. Department of Justice charged Boeing with conspiracy to defraud the FAA Aircraft Evaluation Group in connection with the 737 MAX. Boeing entered a deferred prosecution agreement. The company agreed to pay more than $2.5 billion, consisting of a criminal monetary penalty, compensation to airline customers and a crash-victim beneficiaries fund. The agreement focused on conduct involving two 737 MAX technical pilots and information provided to the FAA AEG concerning MCAS.
A deferred prosecution agreement is not the same as a trial conviction after contested evidence. It is a negotiated criminal resolution under which prosecution is deferred subject to specified obligations. For Boeing, the agreement created a compliance test: could the company demonstrate that systems designed to prevent and detect fraud were functioning effectively?
January 5, 2024: the crisis returned at 16,000 feet
Alaska Airlines Flight 1282 departed Portland, Oregon, for Ontario, California, on January 5, 2024. The aircraft was a Boeing 737 MAX 9 delivered only months earlier.
Soon after takeoff, a left mid-exit door plug separated from the fuselage. The cabin rapidly depressurized. The aircraft returned safely to Portland. There were injuries, but no fatalities. The survival of everyone aboard should not obscure how serious the event was. A large section of the aircraft's fuselage had opened during flight. The NTSB later determined that four bolts intended to prevent upward movement of the door plug were missing before the flight.
This was not MCAS. It was not the same design failure as the two MAX crashes. That distinction matters. But institutionally, the event was devastating because it raised the same deeper question: after years of reform, how could a critical configuration leave Boeing's factory incorrectly assembled?
What happened to the door plug
The NTSB's investigation reconstructed the production history of the aircraft. The door plug had to be opened at Boeing's Renton factory so workers could address rivets near the opening. The plug was subsequently closed. The four bolts that were supposed to prevent the plug from moving upward were not installed.
The NTSB found that Boeing failed to provide adequate training, guidance and oversight necessary to ensure manufacturing personnel consistently complied with required processes. Investigators also criticized the FAA's oversight as ineffective in identifying and ensuring correction of systemic production-quality problems. The accident therefore exposed two layers of failure: Boeing's manufacturing controls and the regulator's ability to detect whether those controls were working.
The missing paperwork problem
One of the most troubling aspects of the door-plug investigation was the absence of normal documentation identifying who had performed the relevant work. In a mature aerospace quality system, critical production steps are supposed to leave records. Those records allow a manufacturer to establish who performed work, which procedures were followed, which inspections occurred and whether deviations were corrected.
Boeing said it believed required documentation had not been created when the plug was opened and reinstalled. The missing record was not merely an administrative inconvenience. It prevented investigators from easily reconstructing responsibility and raised questions about whether informal production practices had developed outside formal quality controls.
Spirit AeroSystems and the outsourcing question
The 737 fuselage involved in the Alaska incident was manufactured by Spirit AeroSystems, a major supplier created when Boeing sold its Wichita commercial-aircraft operations in 2005. Spirit became deeply integrated into Boeing's production system, manufacturing large structures that were then shipped to Boeing for final assembly. Over time, both companies experienced quality problems and production disruptions.
Outsourcing is normal in aerospace. No major aircraft manufacturer produces every component itself. The safety issue is not whether suppliers exist but whether responsibility, engineering authority, inspection and configuration control remain clear across organizational boundaries.
The door plug was opened at Boeing's factory after fuselage delivery, making Boeing's own processes central to the Alaska event. But the wider crisis renewed scrutiny of a supply chain in which financial and production pressure could travel through multiple companies. In 2024 Boeing announced an agreement to acquire Spirit AeroSystems, effectively reversing one of the most consequential outsourcing decisions in its commercial-aircraft history.
The FAA stopped Boeing from simply producing its way out
After the Alaska incident, the FAA grounded 171 737-9 MAX aircraft with the relevant configuration while inspections were developed and completed. More unusually, the regulator told Boeing it would not allow expansion of 737 MAX production until quality-control issues were addressed. The FAA imposed a production ceiling of 38 aircraft per month and increased its presence inside Boeing and Spirit facilities.
The FAA also ordered Boeing to produce a comprehensive action plan addressing systemic quality and safety-culture issues.
This was an extraordinary regulatory intervention. Production rate is normally a commercial and industrial decision. By constraining expansion, the FAA effectively said that Boeing could not solve its financial and delivery problems by accelerating output before demonstrating control of its manufacturing system. In March 2025, Transportation Secretary Sean Duffy said the government was not yet ready to lift the cap and stated publicly that Boeing had lost the trust of the American people. FAA oversight remained enhanced thereafter.
The safety-culture panel had already warned of problems
Before the Alaska accident, an expert panel established under congressional mandate had been examining Boeing's safety-management processes. Its 2024 report found a disconnect between senior management and employees on safety culture and identified concerns about confusing safety processes, communication and the effectiveness of employee reporting systems. It also found that some employees did not understand their role in Boeing's Safety Management System.
The timing was significant. The panel's work showed that organizational concerns were not invented after Flight 1282. They were already visible through a separate review mechanism.
Safety culture is difficult to measure because it is not a component that can be inspected with a gauge. It appears in behavior: whether workers report mistakes, whether managers stop production, whether schedules override concerns, whether retaliation is feared and whether leaders receive accurate information. That makes culture both harder to regulate and more important.
Whistleblowers and the fear of retaliation
Boeing's safety crisis has also been shaped by employees and former employees who publicly raised concerns about manufacturing, quality and engineering.
Some whistleblowers alleged that production pressure led to improper practices or that concerns were not handled appropriately. Boeing has repeatedly said it encourages employees to report safety issues, prohibits retaliation and has strengthened its reporting systems.
Whistleblower allegations require careful treatment. An allegation is not automatically proof, and individual claims can involve factual disputes, employment litigation or technical disagreements. At the same time, a safety system that discourages reporting can hide weak signals until they become accidents.
The FAA and congressional investigators have therefore focused not merely on whether specific whistleblower allegations are ultimately substantiated, but on whether Boeing has a culture in which employees can raise concerns without fear.
The deaths of whistleblowers became part of a separate narrative
Public discussion of Boeing intensified after the deaths of former employees who had raised safety concerns, particularly John Barnett and Joshua Dean.
Barnett, a former Boeing quality manager who had publicly criticized production practices at the 787 program, died in March 2024. Authorities determined that his death was a suicide. Dean, a former Spirit AeroSystems quality auditor who had raised concerns about manufacturing, died weeks later after a severe infection.
Their deaths generated widespread online speculation. There is no credible evidence establishing that Boeing caused either death, and responsible reporting must reject unsupported conspiracy claims.
The relevance of Barnett and Dean lies in the safety concerns they raised while alive, not in speculation about their deaths.
Boeing's relationship with the NTSB deteriorated
During the investigation of Flight 1282, Boeing publicly discussed information concerning the door-plug event in a way the NTSB said violated investigative rules and the company's agreement as a party to the investigation.
In June 2024, the NTSB sanctioned Boeing, restricted its access to investigative information and referred the matter to the Justice Department.
Boeing apologized.
The episode was damaging because accident investigations depend on disciplined information handling. Manufacturers are included as technical parties because investigators need their expertise, but parties are not supposed to use that privileged access to shape the public narrative.
For a company already struggling with trust, the dispute suggested that even crisis communication required reform.
The Justice Department said Boeing breached its 2021 agreement
In May 2024 the Justice Department concluded that Boeing had breached the 2021 deferred prosecution agreement.
The government said Boeing had failed to design, implement and enforce an effective compliance and ethics program to prevent and detect violations of U.S. fraud laws throughout its operations. Boeing said at the time that it believed it had honored the agreement and engaged with the department.
The finding reopened the possibility of prosecution connected to the original MAX fraud-conspiracy charge.
The legal path that followed became controversial, particularly among families of the crash victims, who argued that Boeing should face stronger criminal accountability.
The 2025 non-prosecution agreement
In 2025 the Justice Department and Boeing entered a new non-prosecution agreement, and the government moved to dismiss the criminal charge. The resolution included additional financial commitments and compliance obligations.
Families of victims challenged aspects of the process and argued that their rights had been violated. In March 2026, the U.S. Court of Appeals for the Fifth Circuit rejected mandamus petitions concerning the agreements. The court concluded, among other things, that Boeing's 2024 breach meant the earlier deferred prosecution agreement no longer bound the parties and that the victims' rights statute did not give the appellate court authority to substantively review the dismissal decision in the manner sought.
That legal outcome does not resolve the moral debate over corporate accountability. It resolves specific legal questions about the agreements, victims' rights and judicial authority.
It is important not to misstate Boeing's present legal status: a criminal charge, a deferred prosecution agreement, a government finding of breach and a later non-prosecution resolution are distinct procedural events. None should be casually converted into language suggesting a conviction that did not occur.
Why a $3 million penalty can matter even when Boeing is enormous
Civil penalties measured in a few million dollars can appear trivial beside Boeing's revenues, losses and aircraft programs.
The monetary amount is often not the most important element. Regulatory penalties create a public record of alleged violations, identify failures, require corrective action and can become evidence of a continuing oversight pattern.
For a manufacturer under heightened FAA supervision, each new enforcement action matters because it is evaluated against promises of systemic reform. The question becomes cumulative: are violations declining, are controls improving and is the company detecting problems before regulators do?
Financial penalties alone cannot transform safety culture. Their significance lies in what they reveal about the regulator's assessment of compliance.
Production pressure is not automatically unsafe
One of the easiest mistakes in analyzing Boeing is to treat production targets themselves as evidence of wrongdoing.
Aircraft manufacturing is a business. Airlines need deliveries. Factories need stable rates. Suppliers require predictable demand. Investors evaluate cash flow. Boeing must compete with Airbus.
The safety problem begins when schedule pressure changes behavior: incomplete work is passed forward, defects are not documented, inspections become rushed, employees fear stopping the line or managers receive incentives that reward output without equally powerful safety measures.
Investigators have repeatedly examined this boundary because Boeing's financial recovery depends heavily on increasing production. The company needs more deliveries to generate cash, but regulators insist that higher rates cannot come before stable quality.
That tension is structural and will remain even under new management.
Stock buybacks and the financialization argument
Critics of Boeing frequently point to the tens of billions of dollars the company spent on share repurchases in the years before the MAX crashes.
The argument is that Boeing returned capital to shareholders while underinvesting in engineering, workforce capability or future aircraft development. Supporters of buybacks note that returning excess capital is a normal corporate practice and that the existence of repurchases does not establish that a specific safety program lacked necessary funding.
The more useful question is not whether buybacks are inherently wrong. It is whether Boeing's capital allocation reflected an organizational priority system in which near-term financial performance carried more weight than long-term engineering resilience.
That is difficult to prove with a single number. It must be assessed alongside research and development spending, workforce decisions, program strategy, supplier relationships, executive incentives and the decision to extend the 737 platform rather than launch an all-new aircraft.
Executive compensation and accountability
Corporate accountability is often reduced to whether a chief executive is fired after a crisis.
Dennis Muilenburg left Boeing in December 2019 after the MAX crashes and grounding. David Calhoun became chief executive in 2020 and initially presented his tenure as a period of stabilization and cultural repair. After the Alaska incident, Boeing announced another leadership transition. Kelly Ortberg, an aerospace industry veteran, became CEO in August 2024.
Changing leaders can reset priorities, but it does not automatically change a system. Aircraft programs last decades. Managers inherit decisions made by predecessors. Supplier contracts, workforce skills, factory layouts and certification relationships cannot be transformed in a quarter.
The relevant measure of accountability is therefore not only who leaves. It is whether incentives, reporting lines, engineering authority, training, quality controls and investment decisions change after leadership transitions.
Kelly Ortberg's reset
Ortberg inherited a company facing production restrictions, labor disruption, financial pressure, supplier problems, regulatory scrutiny and damaged public trust.
His strategy emphasized returning leadership closer to engineering and production, improving quality, stabilizing the workforce and rebuilding relationships with regulators and customers. Boeing also moved toward bringing Spirit AeroSystems back inside the company.
The direction addressed several longstanding criticisms: organizational distance, fragmented supply chains and unstable production.
But cultural reform is measurable only over time. A company cannot declare a safety culture repaired. Regulators, employees, airlines and passengers infer it from years of consistent behavior.
The machinists' strike exposed another weakness
In 2024 Boeing's recovery was interrupted by a lengthy strike by tens of thousands of machinists in the Pacific Northwest.
The labor dispute was primarily about compensation and employment conditions, not a direct safety investigation. Yet it highlighted another dimension of Boeing's industrial challenge: retaining and motivating a skilled workforce.
Aircraft manufacturing depends on tacit knowledge. Experienced mechanics understand production sequences, unusual conditions and quality risks that are difficult to replace quickly. Waves of retirements, layoffs, hiring surges and labor conflict can weaken that institutional memory.
Boeing's recovery therefore depends not only on engineering design and executive policy but on rebuilding a stable manufacturing workforce capable of executing those policies repeatedly.
The pandemic damaged the industrial base
COVID-19 arrived while Boeing was already managing the MAX grounding. Air travel collapsed, airlines deferred aircraft, suppliers reduced capacity and skilled workers left aerospace.
When demand returned, manufacturers across the industry struggled to restore production. Parts shortages, engine constraints and workforce turnover affected both Boeing and Airbus.
This context matters because not every Boeing delivery delay or defect is evidence of a uniquely Boeing cultural failure. The entire aerospace supply chain experienced extraordinary disruption.
But Boeing entered that disruption with less margin for error because the MAX crisis had already weakened finances, trust and production stability.
The 787 quality problems broadened the concern
Boeing's manufacturing scrutiny has not been limited to the 737.
The 787 Dreamliner experienced delivery pauses and inspections related to manufacturing quality and fuselage conformity. The FAA increased scrutiny and required Boeing to demonstrate that aircraft met requirements before delivery.
The 787 issues were technically different from MCAS and the MAX 9 door plug. They should not be collapsed into one defect narrative.
Their importance is organizational. When separate programs experience quality-control problems, investigators and regulators naturally ask whether the underlying issue lies in program-specific engineering or in broader systems of manufacturing discipline, supplier management and quality assurance.
The 777X shows the commercial cost of delay
Boeing's next-generation 777X program has also faced years of delay.
Certification challenges, testing requirements and technical issues have pushed entry into service far beyond initial expectations. Delays impose costs on Boeing and airlines and leave the company more dependent on older product families.
Again, delay is not itself evidence of unsafe behavior. In fact, a rigorous certification process that takes longer can be evidence of greater caution.
But strategically, the 777X illustrates how Boeing's safety crisis and regulatory relationship affect its ability to introduce new aircraft. Every future certification decision now occurs under the shadow of the MAX.
Why Boeing cannot simply design a new 737 tomorrow
The obvious long-term solution to an aging aircraft architecture appears to be an all-new narrow-body jet.
The reality is far more difficult. Developing a new commercial aircraft can cost tens of billions of dollars. New engines and manufacturing technologies must mature. Airlines demand efficiency improvements large enough to justify replacing fleets and retraining crews.
Boeing also needs the financial capacity and engineering workforce to launch such a program while completing the 777X, stabilizing the MAX, integrating Spirit and servicing existing debt.
That creates a strategic trap. The company needs a new-generation aircraft eventually, but the crises that make a clean-sheet design attractive have also weakened Boeing's ability to fund and execute one.
Airbus is the competitor Boeing cannot ignore
Boeing's crisis has unfolded while Airbus has strengthened its position in the commercial-aircraft market.
Airlines generally prefer competition between at least two major manufacturers. A world in which one supplier dominates would create its own problems for pricing, capacity and innovation. Boeing's health therefore matters beyond Boeing shareholders.
This is one reason governments and airlines have a complicated relationship with the company. They demand accountability and safety reform while also needing Boeing to remain a credible competitor.
That strategic importance must not become immunity. A company can be systemically important and still require strict regulation. Indeed, systemic importance can justify more oversight because the consequences of failure are larger.
The FAA's own credibility is on trial
Boeing is not the only institution whose reputation was damaged by the MAX.
The FAA certified the aircraft. It relied heavily on delegated authority. It initially resisted grounding the MAX after the Ethiopian crash while other regulators acted. Later investigations identified weaknesses in oversight.
After the Alaska incident, the FAA responded far more aggressively: grounding aircraft, increasing inspectors, auditing production and limiting Boeing's ability to increase output.
The NTSB's 2025 findings nevertheless criticized FAA oversight for failing to ensure Boeing corrected systemic production-quality problems before Flight 1282.
The regulator therefore faces its own institutional challenge. It must oversee Boeing closely enough to protect safety without becoming so embedded that it again depends excessively on the manufacturer it regulates.
Certification reform after the MAX
Congress responded to the MAX crisis with the Aircraft Certification, Safety, and Accountability Act of 2020.
The legislation changed aspects of certification, safety management, human-factors analysis and FAA oversight. It sought to reduce inappropriate pressure on delegated representatives and improve the flow of safety information.
Regulatory reform, however, faces the same problem as corporate reform: rules work only if organizations implement them.
The test is whether engineers feel protected when they raise concerns, whether regulators possess enough technical capability to challenge manufacturers and whether certification schedules remain subordinate to safety when commercial stakes are enormous.
Safety Management Systems: the promise and the limitation
A Safety Management System is intended to make safety proactive rather than reactive. Organizations identify hazards, assess risk, monitor performance and create channels for reporting concerns before accidents occur.
Boeing has expanded its SMS and the FAA has increased requirements surrounding such systems.
But an SMS can become another layer of paperwork if employees do not trust it or leaders do not act on the information it produces. A company can possess dashboards, committees and reporting portals while still failing to detect what happens on a factory floor.
The true measure is whether weak signals lead to intervention.
What Boeing says has changed
Boeing says it has taken extensive actions to improve safety and quality.
Those measures include increased employee training, additional inspections, changes to production processes, greater management presence in factories, expanded use of safety-management tools, quality stand-downs, efforts to reduce traveled work and stronger mechanisms for employees to report concerns.
The company has also slowed production at times to stabilize processes and has supported bringing Spirit AeroSystems back into Boeing.
These actions should be acknowledged. An investigation becomes advocacy if it reports failures but ignores corrective measures.
The unresolved issue is effectiveness. The appropriate question is not whether Boeing has announced reforms, but whether independent evidence shows those reforms producing durable results.
The distinction between an unsafe company and unsafe aircraft
Public discussion often slides from Boeing's institutional failures to the conclusion that every Boeing aircraft is unsafe.
That conclusion is not supported by the evidence.
Commercial aviation safety depends on aircraft design, airline maintenance, pilot training, operational procedures and regulatory oversight. Boeing aircraft conduct enormous numbers of safe flights around the world. The 737 MAX returned to service only after extensive modifications and regulatory review.
Investigating Boeing's failures does not require telling passengers that every Boeing jet is dangerous.
The legitimate concern is systemic: whether the manufacturer consistently produces aircraft that conform to approved designs and whether regulators can detect problems before delivery.
The families changed the accountability debate
Families of the 346 people killed in the MAX crashes have remained central to the legal and political debate.
They have challenged government agreements with Boeing, demanded greater transparency and argued that corporate accountability should include criminal consequences proportionate to the deaths.
Their legal arguments have not always prevailed. Courts are constrained by statutes, prosecutorial discretion and procedural rules.
But the families changed the public meaning of the case. They forced regulators, prosecutors and Boeing to confront a question financial settlements cannot answer: what does accountability mean when institutional decisions contribute to catastrophic loss of life?
That question remains unresolved because criminal law, corporate governance and moral responsibility operate under different standards.
Can a corporation have a culture?
The phrase 'safety culture' can sound imprecise. Corporations do not possess beliefs in the way individuals do.
But organizations create incentives and norms. Employees learn which problems are rewarded, which are ignored, what happens when a line is stopped and whether delivering on schedule is celebrated more visibly than preventing a defect.
Culture appears in thousands of small decisions made when no executive is present.
That is why Boeing's crisis cannot be solved solely by changing a chief executive, rewriting a manual or modifying software. If the underlying incentives remain unchanged, the organization can reproduce similar failures through completely different technical mechanisms.
MCAS and a missing door-plug bolt had almost nothing technically in common. The reason they belong in the same investigation is the possibility that different failures can emerge from shared weaknesses in communication, oversight and organizational discipline.
What would prove Boeing has actually changed?
There is no single metric.
A sustained decline in manufacturing escapes would matter. Stable production without repeated quality pauses would matter. Employee safety surveys would matter. Whistleblower reports would need to be investigated without retaliation. FAA findings would need to decline. Suppliers would need stable processes. New aircraft would need to move through certification without repeating the communication failures of the MAX.
Financial incentives would also matter. If executive compensation and operational targets visibly reward safety, quality and long-term engineering performance alongside deliveries and cash flow, employees receive a different signal.
Most importantly, Boeing would need time.
Trust in aviation accumulates slowly and can disappear in seconds.
The question after the crisis
Boeing's history does not support a simple story in which a once-perfect engineering company suddenly became careless. The company has always been a commercial enterprise operating under competitive pressure, and aviation has always involved technical risk.
What changed was the accumulation of evidence.
Two MAX crashes exposed design, certification and communication failures. Congressional investigators documented management and regulatory weaknesses. The Justice Department brought a fraud-conspiracy charge and later concluded Boeing had breached its deferred prosecution obligations. The Alaska Flight 1282 accident exposed severe manufacturing-control failures. The NTSB found that four critical bolts were missing and criticized both Boeing's production controls and FAA oversight. The regulator imposed extraordinary production restrictions and maintained heightened supervision.
Against that record, promises are no longer enough.
Boeing's future will be determined by whether the company can make safety boring again: no dramatic resets, no emergency stand-downs, no missing documentation, no regulator discovering systemic problems after an incident.
That is the standard because commercial aviation depends on something passengers rarely see but always assume: that thousands of people they will never meet performed thousands of procedures correctly before the aircraft reached the gate.
Boeing once embodied that assumption.
Its task now is to earn it again.
